03 / 02 / 2012 - A Historic Day for Northern Ireland as New Legal Document clarifies law on Abortion

Precious Life has welcomed the publication of a new legal document - "Statement of Law against Abortion and Child Destruction in Northern Ireland" – which was launched at Stormont on Monday 6th February 2012. The event was hosted by the All Party Pro-Life Group of the Northern Ireland Assembly.

The document has been produced by Mrs Johanna Higgins LLB, of the Inn of Court of Northern Ireland, the Kings Inns, Dublin and the Inner Temple, London, Barrister.

Director of Precious Life, Bernadette Smyth said, “This was an historic day for Northern Ireland. The 'Statement of Law against Abortion and Child Destruction in Northern Ireland' is the first legal document ever produced that clearly outlines how the core purpose of the law against abortion and child destruction in Northern Ireland is for the protection of the unborn child.”

“Mrs Higgin’s new document now gives health and legal professionals, and public representatives, a better understanding and clarification of the laws that govern abortion in Northern Ireland.
Unborn children are protected by law in Northern Ireland and abortion is illegal. This, however, does not stop doctors from providing any genuine life-saving treatment that a pregnant mother may require, even in rare cases where the unborn child - after all efforts are made to save his/her life - unintentionally dies.”

The Department of Health, Social Services and Public Safety (DHSSPS) will soon issue revised guidelines on abortion in Northern Ireland. Their Guidance on the Termination of Pregnancy: The Law and Clinical Practice in Northern Ireland was first issued in March 2009. The Guidance was the subject of a Judicial Review in November 2009, when the High Court ruled that parts of it were misleading. The Guidance was withdrawn and revised, and reissued for consultation in 2010. Precious Life has been fighting a long campaign to expose the DHSSPS Guidelines as an attempt to legalise abortion 'through the back door'.

Bernadette Smyth concluded, “This new legal document will help stop any attempt to legalise abortion ‘through the back door’ by misinterpreting the law here. It must now also put an end to the lie churned out by pro-abortion organisations like the FPA - and reported as truth by the media - that abortion is legal in Northern Ireland in 'certain circumstances'. Killing a child in the womb is NEVER legal under ANY circumstances in Northern Ireland. Precious Life will continue working to keep abortion not only illegal but unthinkable!”
